Site-specific policy: These Uploader Terms apply to anyone who uploads video content to The Jammin' Review (
jamminreview.com). They supplement the Music Hall of Fame Club Terms of Use published atmusichofc.com/policies/terms, which controls in case of any inconsistency.
Introduction
The Jammin' Review is a music-focused video platform operated by Jammin' Alpacas™ LLC, a Delaware limited liability company located at 120 Eagle Rock Avenue, Suite 155, East Hanover, NJ 07936.
These Uploader Terms govern the relationship between you (the "Uploader") and Jammin' Alpacas™ LLC ("we," "us," "our") when you upload video content to The Jammin' Review.
By uploading content, you agree to these Uploader Terms.
Why we built The Jammin' Review
The Jammin' Review exists for one reason: to be a place where great music finds its audience.
Music Hall of Fame Club members include music industry professionals and active members of the music community. These members may view, vote on, and engage with content uploaded to The Jammin' Review. Our goal is to create a space where work has a real chance of being seen by people who can recognize and act on what they find.
This is our goal — not a guarantee. Jammin' Alpacas™ LLC does not represent or warrant that any specific upload will be viewed by any specific Club member, will be selected for Spotlight, will result in industry contact, or will produce any commercial, professional, or career outcome. Uploading does not create any obligation on the part of Jammin' Alpacas™ LLC or any Club member to engage with, respond to, or pursue any business or creative relationship with the Uploader.
You upload because you want your work to have a chance to be seen. We provide the room. The room is real. The outcomes are not promises.
1. Eligibility to Upload
To upload content to The Jammin' Review, you must:
- Be at least eighteen (18) years old
- Have the legal capacity to enter into binding agreements under the laws of your jurisdiction
- Have an active Jammin' Review account in good standing
- Not be located in, organized under the laws of, or a citizen or resident of any jurisdiction subject to comprehensive U.S. sanctions (as described in the Music Hall of Fame Club Terms of Use)
- Not have been previously suspended or banned from The Jammin' Review or any other Music Hall of Fame Club property for cause
- Comply at all times with these Uploader Terms, the Music Hall of Fame Club Terms of Use, the Music Hall of Fame Club Community Guidelines, our DMCA Policy, our Music Licensing & Acceptable Content Policy, and our Content Moderation Policy
If you do not meet these eligibility requirements, you must not upload content to The Jammin' Review.
2. What You Can Upload
You may upload video content that you have the legal right to upload under one of these categories:
2.1 Original Content (your own work)
Video content created by you that you own outright, including:
- Video recordings of your original musical compositions, performed by you
- Video recordings of your performances of musical works you have the right to perform (cover songs only where you have obtained or genuinely qualify for the necessary licenses)
- Video recordings of your original instrumental work, vocal work, songwriting, or production
- Video recordings of you teaching, demonstrating, or discussing music
2.2 Band or Group Content
Video content uploaded by a band or group, where:
- All members of the band or group consent to the upload
- The Uploader is authorized by the band or group to act as the official uploader
- The content depicts performances or work by the band or group itself
2.3 Partner Content
Video content uploaded by, or with the explicit authorization of, a music industry partner (instrument maker, gear maker, label, publisher, music school, or other Music Hall of Fame Club partner organization), where:
- The Uploader is authorized to upload on behalf of the partner organization
- The content was created by or commissioned by the partner organization
- The Uploader has authority to grant the rights described in Section 4 below
2.4 Audience Recording of Taping-Friendly Artists
Video content recorded by you at live performances of artists who have publicly opted into audience recording (often called "taping-friendly" artists or bands with established tapers' policies), where:
- The artist's publicly available taping policy permits audience recording
- The artist's policy permits the type of recording you made (some bands restrict certain formats, certain venues, certain types of equipment)
- The recording complies with the artist's policy on commercial use, redistribution, and audio source (e.g., audience-only vs. soundboard)
- The venue's filming policy was not violated when the recording was made
We maintain a curated list of artists confirmed as taping-friendly under our Music Licensing & Acceptable Content Policy. Uploads of artists on that list need only the standard upload-time representations. Uploads of artists not on the list require you to attest specifically that you have the artist's permission, and we reserve the right to verify that attestation before publishing the upload.
2.5 Content Where You Have All Necessary Rights
Any other category of video content where you can confirm, in good faith, that you have:
- Ownership or authorization for all musical compositions in the recording
- Ownership or authorization for all sound recordings used
- Permission from any identifiable performers, including yourself
- Permission from the venue (if filmed at a venue with restricted filming policies)
- Any other rights or releases required for the specific upload
If you are unsure whether you have the rights to upload specific content, do not upload it. Reach out to us at help@jamminreview.com if you have questions about a specific scenario.
3. What You Cannot Upload
You may not upload:
- Content you did not create and do not have explicit authorization to upload
- Lip-syncs or performances over commercial sound recordings you do not own or license
- Recordings of artists who have not opted into audience recording (or who have explicitly prohibited it)
- Music where you do not own or have license to both the composition and the sound recording (or where one party's authorization extends only to certain uses)
- Concert footage taken in violation of a venue's filming policy
- Content that infringes anyone's copyright, trademark, publicity rights, privacy rights, or other intellectual property
- Content that violates the Music Hall of Fame Club Community Guidelines (hate speech, harassment, illegal activity, sexual content, content depicting or sexualizing minors, etc.)
- Content depicting violence, self-harm, or other prohibited categories
- Content that is misleading, fraudulent, deceptive, or designed to manipulate viewers (including artificial engagement, deepfake performances misrepresenting real artists, or content designed to game voting)
- Content created using AI or machine-generated music tools and presented as if it were human-performed work, without clear disclosure
- Content that promotes or endorses scams, fraud, or other illicit activity
- Content that the Music Licensing & Acceptable Content Policy prohibits
We may, at our discretion, restrict additional categories of content over time. Material additions to the list of prohibited content will be communicated through The Jammin' Review.
4. The License You Grant Us
When you upload content to The Jammin' Review, you grant Jammin' Alpacas™ LLC the following license to that content. Read this section carefully. It is intentionally narrow and protects your ability to do business with your work elsewhere.
4.1 Scope of License
You grant Jammin' Alpacas™ LLC a worldwide, non-exclusive, royalty-free, sublicensable (only as described in Section 4.3 below) license to:
- Host the content on The Jammin' Review and on any infrastructure (servers, content delivery networks, cloud services, backups) reasonably necessary to operate the platform
- Display the content on The Jammin' Review to viewers, voters, and Music Hall of Fame Club members
- Feature the content within The Jammin' Review (including in Spotlight, in curated collections, in editorial features, and in similar surfacing mechanisms within the platform)
- Make the content available to viewers on different devices and at different resolutions, including standard streaming optimizations
- Display, share, embed, and promote the content within the Music Hall of Fame Club ecosystem (musichofc.com, jamminalpacas.com, merch.musichofc.com, jamminreview.com, our official social channels, and our official Discord), specifically for the purpose of presenting the content to Music Hall of Fame Club members and the broader music community
This license lasts for as long as the content remains on The Jammin' Review, plus a reasonable period thereafter for archival, legal compliance, and backup purposes.
4.2 What We Cannot Do With Your Content
We cannot, without your separate written agreement:
- Sell or commercially license your content to third parties
- Use your content in advertising for products other than The Jammin' Review and the Music Hall of Fame Club ecosystem
- Modify your content beyond what is necessary for hosting and display (e.g., we may compress for streaming; we will not edit your performance)
- Distribute your content outside the Music Hall of Fame Club ecosystem without your consent
- Use your name, image, or likeness in ways beyond what is reasonably necessary for hosting and featuring the content you uploaded
- Train, fine-tune, or otherwise improve any artificial intelligence or machine-learning model using your content
- Grant licenses to third parties to use your content in their own products or services
4.3 Limited Sublicensing
The only sublicenses we may grant under this license are to our infrastructure and operational vendors (hosting providers, content delivery networks, transcoding services, security services), strictly for the purpose of operating The Jammin' Review on our behalf. These vendors are bound by terms equivalent to those in Section 4.2 above.
4.4 You Keep Everything Else
You retain ownership of, and the unrestricted right to use, all content you upload. Specifically:
- You can sign with a label, publisher, distributor, agency, or any other partner using the same content
- You can release the same content on Spotify, Apple Music, YouTube, Bandcamp, SoundCloud, or any other platform
- You can sell, license, or transfer the content
- You can take the content down from The Jammin' Review at any time (see Section 7)
The Jammin' Review hosting your content does not interfere with your ability to do anything else with it.

Your Representations and Warranties
By uploading content to The Jammin' Review, you represent and warrant to Jammin' Alpacas™ LLC that:
5.1 Rights
- You own the copyright in the content you upload, OR you have all necessary licenses, permissions, and authorizations from the rightful owners to upload the content and to grant the license in Section 4
- You have all necessary releases from any identifiable performers, including yourself
- For audience recordings of taping-friendly artists (Section 2.4), you have followed the artist's published taping policy
- For partner content (Section 2.3), you are authorized to act on behalf of the partner organization
5.2 Compliance
- The content does not infringe any third party's copyright, trademark, publicity rights, privacy rights, or other intellectual property
- The content does not violate any applicable law, regulation, or contract you are bound by
- The content does not violate the Music Hall of Fame Club Community Guidelines or our Music Licensing & Acceptable Content Policy
- You are not located in a sanctioned jurisdiction, and your upload does not violate U.S. sanctions or export control laws
5.3 Truth
- The information you provide about the content (including any titles, descriptions, tags, performer attributions, and category designations) is accurate and not misleading
- If the content is original work, you actually created it
- If the content is a recording of a taping-friendly artist, you actually attended that performance and you actually made (or have the right to upload) that recording
5.4 Authority
- If you are uploading on behalf of a band, group, or organization, you have the authority to upload on their behalf and to grant the rights in these Uploader Terms
These representations are continuous: they apply at the time you upload, and they remain in effect for as long as the content is on The Jammin' Review.
6. Consequences of False Representations
You are responsible for the accuracy of your representations under Section 5 and the consequences if they are false.
6.1 What we will do if a representation appears false
If we receive a credible claim that you do not have the rights you represented (for example, a DMCA notice from a copyright holder), we will:
- Remove the content "expeditiously" as required by U.S. copyright law and our DMCA Policy
- Notify you that the content was removed and why
- Give you the option to submit a counter-notice if you believe the takedown was wrong (see DMCA Policy)
- Track the incident as part of our repeat-infringer policy under Section 6.3
6.2 What you may be liable for
You agree to indemnify, defend, and hold harmless Jammin' Alpacas™ LLC and its affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- A breach of any representation or warranty in Section 5
- Your upload of content you did not have the rights to upload
- Your violation of these Uploader Terms or any other Music Hall of Fame Club policy
- Any false or misleading information you provided about the content
This is the standard "the uploader bears the legal risk of false rights claims" provision required to make the platform's safe harbor protections work. If you upload content you don't have rights to, the legal exposure is yours, not ours.
6.3 Repeat-Infringer Policy
In compliance with §512(i) of the Digital Millennium Copyright Act, we maintain a repeat-infringer policy. Accounts that accumulate multiple confirmed copyright infringement strikes will be terminated. Specific details on how strikes are counted and the threshold for termination are in our DMCA Policy.
7. Removing Your Content
7.1 You can remove your content at any time
You can delete any content you uploaded through your account settings, or by contacting help@jamminreview.com. Removal typically takes effect within 24 hours, though backup copies may persist for a reasonable additional period (up to 90 days) for legal compliance, dispute resolution, and operational purposes.
7.2 We may remove your content
We may remove content from The Jammin' Review, with or without notice to you, if:
- We receive a valid DMCA takedown notice
- We determine the content violates these Uploader Terms or any other Music Hall of Fame Club policy
- The content is the subject of a credible legal claim or pending dispute
- We are required to remove the content by law, regulation, or court order
- We believe in good faith that removal is necessary to protect the platform, other users, or third parties
We try to apply removal decisions fairly and consistently. The Content Moderation Policy describes the process for moderation actions and the appeals path.
7.3 What happens to derivative platform features
If your content is removed, any votes, Spotlight features, partner highlights, or other platform-level recognition associated with that specific upload also end. This does not affect anything outside The Jammin' Review (such as deals you may have negotiated with Club members based on the visibility you received).
8. Account and Profile
8.1 Account requirement
You must have a Jammin' Review account to upload content. Account creation requires:
- A valid email address
- Confirmation of age (18+) and eligibility (Section 1)
- Agreement to these Uploader Terms, the Music Hall of Fame Club Terms of Use, the Privacy Policy, and the Community Guidelines
8.2 Profile content
Your Jammin' Review profile may include:
- A username (which may be your real name, a stage name, or a band name)
- A short biography or description
- Links to your other platforms (your website, Bandcamp, Spotify, social media, etc.)
- An optional profile contact (an email address or social handle that you choose to publish for industry contact, fan inquiries, or collaboration requests)
You control what you publish on your profile. The profile contact is optional and entirely at your discretion. Publishing a contact does not create any obligation on you to respond to inquiries; it simply makes a contact available to viewers and Music Hall of Fame Club members who want to reach you.

You consent to having your username, profile image, and uploaded content displayed on The Jammin' Review and within the Music Hall of Fame Club ecosystem in connection with your uploads. You retain all other rights of publicity in your name, image, voice, and likeness. The license in Section 4 does not authorize any use of your name, image, or likeness beyond what is reasonably necessary to display and feature your uploads on the platform.
9. No Industry Contract or Agency Relationship
We want to be explicit about what The Jammin' Review is and is not.
Jammin' Alpacas™ LLC is not your music licensing intermediary, your agent, your manager, your representative, your label, your publisher, or your fiduciary. Hosting your content on The Jammin' Review does not create any of these relationships.
If a Music Hall of Fame Club member (a producer, a label representative, a music supervisor, a venue programmer, a partner organization, or anyone else) sees your work and wants to engage with you, that is a direct relationship between you and that party. Jammin' Alpacas™ LLC is not a party to that relationship, has no responsibility for the conduct of either side, and earns no commission, fee, finder's fee, or other consideration from the relationship.
You and the Music Hall of Fame Club member negotiate any subsequent agreement directly. You are responsible for your own due diligence, your own contracts, and your own legal advice in any subsequent business relationship.
10. No Idea-Disclosure or First-Look Obligations
Uploading content to The Jammin' Review does not create any obligation on the part of any Music Hall of Fame Club member to:
- Refrain from creating similar work
- Pay you for ideas reflected in your upload
- Give you first-look rights, options, or rights of refusal
- Disclose to you any work they are developing
- Avoid working with other artists in similar styles or genres
- Acknowledge having seen your upload
If a Club member subsequently produces work that you believe is derivative of yours, that dispute is between you and the Club member, governed by the substantive copyright and intellectual property laws of the relevant jurisdiction. Jammin' Alpacas™ LLC is not responsible for adjudicating such disputes, is not a party to them, and provides no representations about whether any subsequent work was influenced by an upload to The Jammin' Review.

The disclaimers and limitations of liability set out in the Music Hall of Fame Club Terms of Use apply to your use of The Jammin' Review and to your activity as an Uploader. Specifically:
- The Jammin' Review is provided "as is" and "as available"
- We make no representations or warranties about the platform's availability, reliability, security, or freedom from defects
- We make no representations about the discovery, audience, or career outcomes that any specific upload may produce (see "Our goal — not a guarantee")
- Our aggregate liability to you is limited as described in the Music Hall of Fame Club Terms of Use
These limitations apply to the maximum extent permitted by applicable law.
12. Termination
12.1 You can leave at any time
You can stop uploading and delete your account at any time through your account settings, or by contacting help@jamminreview.com. Account deletion removes your profile and discontinues your uploads, subject to the backup-retention period described in Section 7.1.
12.2 We can terminate accounts
We may suspend or terminate your Jammin' Review account, with or without notice, for:
- Violation of these Uploader Terms or any other Music Hall of Fame Club policy
- Repeat copyright infringement (per the Repeat-Infringer Policy in our DMCA Policy)
- Fraud, manipulation, or abusive behavior on the platform
- Conduct that endangers other users or the platform
- Any reason permitted under the Music Hall of Fame Club Terms of Use
Upon termination, your uploaded content is removed, the license in Section 4 ends with respect to that content, and you must not attempt to circumvent the termination by creating a new account. Sections that by their nature should survive termination (including Sections 5, 6, 9, 10, 11, 13) survive.
13. General
13.1 Updates
We may update these Uploader Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated through The Jammin' Review where feasible. Your continued use of The Jammin' Review after an update constitutes acceptance of the updated Uploader Terms.
13.2 Governing law and disputes
Governing law and dispute resolution for these Uploader Terms are as set forth in the Music Hall of Fame Club Terms of Use, which are incorporated here by reference.
13.3 Entire agreement
These Uploader Terms, together with the Music Hall of Fame Club Terms of Use, the Privacy Policy, the Community Guidelines, the DMCA Policy, the Music Licensing & Acceptable Content Policy, the Content Moderation Policy, and the Voting & Spotlight Policy, constitute the entire agreement between you and Jammin' Alpacas™ LLC regarding your activity as an Uploader on The Jammin' Review.
13.4 Severability
If any provision of these Uploader Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
