Site-specific policy: This DMCA Policy applies to The Jammin' Review (jamminreview.com). The Jammin' Review is the only Music Hall of Fame Club property that hosts user-uploaded video content; this policy is therefore specific to that platform. The master Music Hall of Fame Club Terms of Use at musichofc.com/policies/terms reference this policy and incorporate it by reference for matters involving Jammin' Review uploads.


Introduction

The Jammin' Review is a music-focused video platform operated by Jammin' Alpacas™ LLC, a Delaware limited liability company located at 120 Eagle Rock Avenue, Suite 155, East Hanover, NJ 07936.

We respect the intellectual property rights of others. This DMCA Policy explains how copyright owners can submit takedown notices for content on The Jammin' Review, how Uploaders can respond with counter-notices, how we handle repeat infringement, and who to contact.

This policy is designed to comply with the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. §512.


1. Our Designated Agent

The Designated Agent is the formal point of contact for DMCA takedown notices. We recommend submitting all formal notices to the Designated Agent listed above. The platform-direct address is provided as a courtesy for cases where rights holders contact us before locating the Designated Agent registration.

The Designated Agent for The Jammin' Review is registered with the U.S. Copyright Office. The official registration is searchable in the Copyright Office's DMCA Designated Agent Directory at dmca.copyright.gov.


2. Submitting a Copyright Takedown Notice

If you believe that content on The Jammin' Review infringes your copyright, you may submit a takedown notice to our Designated Agent.

2.1 Required Elements

To be valid under the DMCA, your notice must include all of the following elements (this is not optional — these elements are required by 17 U.S.C. §512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works on a single site are covered by a single notice, a representative list of those works)
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material — typically the URL of the upload on The Jammin' Review (e.g., https://jamminreview.com/v/[upload-id])
  4. Information reasonably sufficient to permit us to contact you, including your name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf

2.2 What to Include

To help us process your notice quickly, please also include:

  • A clear description of the original work, including where it was previously published or registered (if applicable)
  • The relationship between you and the original work (you are the copyright owner; you are the authorized agent of the copyright owner; you are an attorney representing the copyright owner; etc.)
  • Any registration information for the copyright (U.S. Copyright Office registration number, if applicable)

2.3 Where to Submit

Submit notices to the Designated Agent at the contact information in Section 1.

2.4 What Happens Next

When we receive a notice that meets the DMCA's requirements:

  • We will remove or disable access to the allegedly infringing content "expeditiously" (typically within 24 to 72 hours of receipt)
  • We will notify the Uploader that the content was removed and provide them with the basis for the takedown
  • We will give the Uploader the opportunity to submit a counter-notice (see Section 3)
  • We will record the takedown as part of our repeat-infringer tracking (see Section 4)

We do not adjudicate copyright disputes. Our role under the DMCA is procedural: we receive valid notices, we remove the identified content, and we provide the counter-notice process so the dispute can be resolved between the parties (or, if necessary, in court).

2.5 Misuse of the DMCA Process

Submitting a knowingly false or misleading DMCA notice may subject you to liability under 17 U.S.C. §512(f), which provides that "[a]ny person who knowingly materially misrepresents under this section that material or activity is infringing... shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner... or by a service provider, who is injured by such misrepresentation."

We reserve the right to seek damages from parties who submit notices in bad faith, who submit notices regarding content they do not own, or who use the DMCA process to harass Uploaders.


3. Submitting a Counter-Notice

If you are the Uploader of content that has been removed in response to a DMCA notice, and you believe the takedown was wrong, you may submit a counter-notice. Reasons a takedown may be wrong include:

  • You actually own the copyright in the content
  • You have a license to use the content
  • The use is fair use under 17 U.S.C. §107
  • The takedown notice misidentified the content
  • The content was already in the public domain

3.1 Required Elements

Your counter-notice must include all of the following (these are required by 17 U.S.C. §512(g)(3)):

  1. Your physical or electronic signature
  2. Identification of the material that has been removed and the location at which it appeared before it was removed
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for the judicial district in which we may be found, which is the District of Delaware), and that you will accept service of process from the person who provided the original takedown notice or their agent

3.2 Where to Submit

Submit counter-notices to the Designated Agent at the contact information in Section 1.

3.3 What Happens Next

When we receive a valid counter-notice:

  • We will provide a copy of the counter-notice to the original complainant
  • We will inform the complainant that we will restore the content in 10 to 14 business days unless the complainant files a court action seeking a court order against the Uploader
  • If the complainant does not file such an action within the timeframe, we will restore the content
  • If the complainant does file such an action, we will keep the content removed and the dispute will be resolved by the court

3.4 Misuse of the Counter-Notice Process

Submitting a knowingly false or misleading counter-notice is also subject to liability under 17 U.S.C. §512(f). Do not submit a counter-notice unless you genuinely believe in good faith that the takedown was wrong.


4. Repeat-Infringer Policy

In compliance with 17 U.S.C. §512(i)(1)(A), we maintain and "reasonably implement" a policy of terminating the accounts of repeat infringers.

4.1 How Strikes Work

When we receive a valid DMCA takedown notice and remove an Uploader's content, that constitutes a copyright strike against the Uploader's account, unless:

  • The Uploader successfully submits a counter-notice and the content is restored, in which case the strike is removed
  • The original notice is determined to have been submitted in bad faith or by mistake, in which case the strike is removed
  • The notice is withdrawn by the original complainant, in which case the strike is removed

4.2 Strike Threshold

An Uploader who accumulates three (3) confirmed copyright strikes against their account within any 12-month rolling period will have their account terminated. Confirmed strikes that have not been removed under Section 4.1 above count toward the threshold.

4.3 Effect of Termination

When we terminate an account under this Repeat-Infringer Policy:

  • All content uploaded by that account is removed from The Jammin' Review
  • The Uploader's profile and account are deactivated
  • Future Music Hall of Fame Club ecosystem accounts created by the same person to circumvent the termination will also be terminated upon discovery
  • Termination is permanent for the affected account, except in the limited cases described in Section 4.4

4.4 Reinstatement

In limited cases, an Uploader may apply for reinstatement after termination. Reinstatement is at our sole discretion and may be granted where:

  • All of the strikes triggering termination are subsequently removed (counter-notice succeeds, original notice withdrawn, etc.)
  • The Uploader can demonstrate that the strikes were the result of a misunderstanding, technical error, or third-party impersonation
  • The Uploader provides credible assurances of future compliance

5. International Notices

We honor copyright takedown notices submitted under the DMCA. We may, at our discretion, also honor notices submitted under analogous laws of other jurisdictions (such as the EU Copyright Directive, the UK Online Safety Act, or others), but we are not required to do so. International rights holders are encouraged to use the DMCA process described above for content on The Jammin' Review.


6. Other Intellectual Property Concerns

This DMCA Policy applies specifically to copyright infringement claims under the DMCA. For other intellectual property concerns:

  • Trademark infringement: Contact policies@mhofc.com with details of the infringement, your trademark registration (if applicable), and the content at issue
  • Right of publicity / right of personality claims: Contact policies@mhofc.com
  • Trade secret claims: Contact policies@mhofc.com
  • Patent infringement: Generally outside the scope of UGC platform issues; contact policies@mhofc.com for guidance

7. Records

We maintain records of all DMCA notices, counter-notices, takedowns, and repeat-infringer strikes for a period sufficient to satisfy our legal obligations and to support our DMCA compliance program. These records are confidential, except as required by law.


8. Updates to This Policy

We may update this DMCA Policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material updates will be communicated through The Jammin' Review.

This DMCA Policy describes our procedures for handling copyright matters under U.S. law. It is not legal advice.
